Appendix of Standard Engagement Contract

I Work Assignment
The appropriate department will provide the teacher’s work assignments as soon as possible and will provide changes to the assignments in a timely manner. The teacher will endeavor to provide a reasonable quality of teaching at all times, also in the absence of a formal curriculum, will make their best effort to provide teaching material appropriate for the assigned classes.
II Compensation
A. Salary
1. The salary of________RMB per month will be paid for______ hours of teaching per week. In the case of an incomplete month, the payment will be calculated base on a daily rate of 1/30 of the monthly rate, this would include all months. (Based on regulatory issues, no more than 70% of the teacher’s salary can be converted to foreign currency). Due to the amount of time required to convert to foreign currency, LUT will provide this service to the foreign teachers at the completion of each semester. The employed party shall pay all personal income tax in accordance with the Personal Income Tax Law’s of the People’s Republic of China.
B. Benefits
1. Accommodation
The employing party will provide accommodations to the foreign teacher for the duration of the contract, the accommodations will include: furniture, bedding, television, telephone, refrigerator, western style toilet, heating and cooling facilities. The foreign teacher is responsible for maintaining the accommodations in good condition; this would include notifying the employer in a timely manner of any repairs required.
2. Medical Insurance (for a one academic year contract)
The employing party will buy the basic health and accident insurance for the foreign teachers under 60 years old.
3. Airfare
LUT will provide the foreign teacher a round-trip international economy class air ticket using the most direct and inexpensive routing between China and the country of the foreign teacher for a two-semester contract and a one-way international air ticket for a one-semester contract. Payment will be made at the completion of the contract unless otherwise negotiated.
4. Internet
Free Internet connection will be available in each foreign teacher’s apartment.
III Working hours, holidays and vacation
A. The work hours will be 8:00 am to 5:30 pm Monday to Friday, as per the terms stipulated in Section II, 1.
Note: As a point of clarification, the hours agreed on are teaching hours as they do not include preparation time, making papers, attendance to English Corner (minimum once per month) and staff meetings.
B. If additional hours are requested, and agreed to by the foreign teacher, the employer agrees to pay the foreign teacher RMB_50_ per hour.
C. The foreign teacher is entitled to the following paid holidays in China: New Years Day, Spring Festival, May Day, National Day and other days stipulated by Chinese law.
D. The foreign teacher’s is entitled to one of the following festivals and holidays corresponding to their nationalities and religion: two days for Christmas, two days for Corban, one day for Lesser Bairam or Id al-Fitr.
E. Foreign teachers who have signed a one-year contract are entitled to a four week paid summer or winter vacation.
F. A foreign teacher working for 5 consecutive years must leave China for 2 years before returning to resume a teaching position.
IV Sick Leave and Personal Absences
1. At the time of requesting a sick leave, the foreign teacher requires a certificate from the designated medical facility. If the sick leave is less than 30 days within one contract year (one year or one contract year), the employed will be paid 100% of their salary. If the sick leave exceeds 30 days, the host institution has the right to terminate the contract, or the institution may choose to continue the contract and pay the foreign teacher 70% of the contracted salary. The employer will assess this situation every 30 days.
2. Personal absences must be requested in writing to the employer. The terms and conditions of the absence will be negotiated in good faith. The terms and conditions must be agreed to prior to the employee taking the leave.
V Probation
The probationary period of the foreign teacher is 30 days. Within the probation period if the employer finds reasonable grounds that the foreign teacher is unfit to complete the signed contract, for reasons of health or professional ability the contract can be terminated.
VI Exclusions to Contract
Any and all items not covered within the terms and conditions of this contract will be negotiated in go faith by both parties and will become part pf this contract. This item will not be grounds to terminate the contract unless that is an agreed solution by both parties.
VII Changes
Changes to this agreement must be submitted to the other party in writing and shall be negotiated in good faith by both parties. The agreed solution will become part of this contract. The requested changes will not become grounds to terminate the contract.
This appendix has equal status with the standard contract and comprises an integral part of the standard contract.
